Terms and Conditions

These are the terms on which we supply any products from our website (the Products)

your contract: your contract will be with Backpack Groomer Ltd (registered in England number 4514664; Vat no: 847771287) registered office: The Barn, Mill Farm Stables, Stainby Road Colsterworth, Lincs. NG33 5JB, UK (“Backpack Groomer Ltd”, “we” or “us”). 

When confirmation of order is received, this is simply to indicate that we have received your order, not that a contract exists between us at that point. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice (a “Contract”). We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable. 

where we supply: the Backpack Groom/n/vac is designed for use in the UK and the European Union.  The machine has CE approval and is available with either a UK 3 pin plug or a European two pin "Schuko" plug.  If you are ordering for delivery outside the UK or Europe, you must comply with all applicable electrical safety and other laws and regulations of the country for which the Products are destined. We will not be liable for any breach by you of any such laws.

shipping & handling: postage and packing prices on the website are for delivery within mainland UK only. For delivery elsewhere in the UK or Europe there will be additional charges. Please contact us and we will give you a separate estimate.

delivery: we will dispatch your order as soon as reasonably practicable after we confirm it. Normally this will be within 10 business days for mainland UK orders.  For deliveries elsewhere in the UK or Europe we will advise you separately of delivery times.  

risk and title: the Products will be at your risk from the time of delivery. Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.

back orders: if your item is not in stock, we will back order for you. You will always be emailed with the option to cancel your order if you would rather not wait. 

taxes and import duty: for orders made from the UK or the European Union, 17.5% VAT is included in the prices. If you order Products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

credit card security: when the order is placed at our website, credit card numbers are encrypted using 128 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any web site. 

guarantee: theBackpack Groom/n/vac must be used in a safe manner in accordance with the instructions provided and having regard to your horse's temperament. We cannot accept any liability whatsoever for loss, including consequential loss, damage or injury caused by misuse of the machine, failure to follow the instructions or failure to take sensible precautions when working around animals.

The Backpack Groom/n/vac comes with a 1 year manufacturer’s warranty in respect of defects in materials or workmanship. However, the warranty expressly excludes consumable parts such as brushes, tools, hoses and tubes that are considered replaceable during the normal working life of the machine.

Claims will not be accepted if they are the result of fair wear and tear, misuse or abuse of any kind. In particular, claims will be rejected if the machine has been used without a filter or if any moisture or hazardous substance has been allowed to enter it or if the filters have not been regularly cleaned and dust chamber emptied and cleaned). The machine is for dry use only and is not to be used to vacuum horse droppings or any other wet materials.

The warranty period commences from the date the goods are received by you. All warranty claims must be processed through BackPack Groomer Ltd if purchased direct, or,if not, through the seller from whom the equipment was purchased. You may be asked to produce proof of purchase. This warranty does not affect your statutory rights. Warranty repairs can only be carried out by an authorised distributor or service agent and freight costs will be the purchaser's responsibility.  Unauthorised repairs may invalidate the warranty.  If the supply cord is damaged, it must be replaced by us, our service agent or suitably qualified person to avoid a hazard.

your right to cancel: your rights to return goods are protected under the Consumer Protection (Distance Selling) Regulations 2000 (as amended) which can be found at http://www.hmso.gov.uk

If you are contracting as a consumer, you may cancel your Contract at any time within seven working days (the "cooling off period"), beginning on the day after you received the Products. In this case, you will receive a full refund of the price paid for the Products in accordance with our refunds policy set out below. 

To cancel a Contract, you must inform us in writing by post at the address supplied below or by email to  . You must also return the Product(s) to us immediately, in the same condition in which you received them, and at your own cost and risk. You have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.  If you wish to make any complaint about the supply of Products please contact us in writing at the address supplied below.

21 DAY TRIAL OFFER:we offer a 21 day trial period for the BackPack Groom/n/vac where your right to cancel is extended to 21 days from the day of receipt by you. If for any reason you want to cancel within this period you must notify us - in writing by post at the address supplied below or by email to   - that you wish to cancel the transaction. We will refund you the purchase price and the cost of delivery to you. All we ask of you is that you pay for the safe return to us of the BackPack Groom/n/vac in the original packaging, complete with all attachments, undamaged, clean, and in the same condition in which it was dispatched. Provided it is complete, undamaged and in the same condition as when dispatched, we will refund you the purchase price and the cost of delivery to you.

We will only accept the return of goods after the 21 day period referred to above if they are covered by the terms of the manufacturer's warranty. 

refunds: when you return a Product to us: 

(a) because you have cancelled the Contract between us within the seven-day cooling-off period or the 21 day trial period, we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation. In this case, we will refund the price of the Product in full, including the cost of sending the item to you.  However, you will be responsible for the cost of returning the item to us.  

(b) for any other reason (for example, because you have notified us that you do not agree to any change in these terms and conditions or in any of our policies, or because you claim that the Product is defective), we will examine the returned Product and will notify you of your refund via e-mail within a reasonable period of time. We will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via e-mail that you were entitled to a refund for the defective Product. Products returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to us. 

We will usually refund any money received from you using the same method originally used by you to pay for your purchase.  

severability: if any of these terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law. 

law and jurisdiction:Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
